NMS-Cares Mobile Film Contest 2020

A. Rules and Guidelines

Please read and carefully consider the following rules and guidelines for this years NMS-Cares Mobile Film Contest 2020 before submitting your entry. NMS-Cares is a non-profit organization duly registered and recognized by the Philippines Securities Exchange Commission.

B. To Enter

1. The films may be of any genre (i.e. horror, comedy, action, documentary, sci-fi etc.) Entries may be live-action, animation, or a combination of both.
2. Entry is open to all amateur filmmakers.
3. Participants may work individually, in pairs or in groups.
4. Each participant, individual or group, may submit a maximum number of 2 significantly unique entries. An entry may only be submitted once.

C. All Entries Must Adhere to the Following Rules and Guidelines

1. Each Mobile Film entree must be based on this year's theme: Building an accessible future together. We encourage the participants to be creative in portraying the theme in their films. The films must help forward the advocacy of NMS-Cares.
2. All entries must be made using mobile phones ONLY. The use of any other device for capturing videos, films, and images is prohibited.
3. Entries should be made specifically for the NMS-Cares Mobile Film Contest 2020.
4. Each entry must be no longer than 5 minutes, including Opening and/or Closing credits are not required, but if included, must not exceed 30 seconds in total.
5. A prepared title slide, introducing the film as submitted in response to the initiative of NMS-Cares, Inc. must be included at the beginning of the film.
6. Films may be in any language or have no dialogue at all. However, all films are required to have English subtitles to be inclusive of Deaf viewers.
7. Ensure that all media included in the film must be original and your own. Materials that are classified Public Domain can be used.
8. All entries must be submitted online (including the uploading of the film and a poster images on your entry/ies) by the close of entries: April 26, 2020, at 6 pm.
*Note: Any entry that does not comply to these requirements are considered as ineligible to participate in the NMS-Cares Mobile Film Contest.

D. Submission of Entry

For an entry to be qualified, it must be submitted online:

1st Prize: Php 5,000
2nd Prize: Php 3,000
3rd Prize: Php 2,000

F. Judging Criteria

-Was the direction creative, innovative, and artistic in conveying the theme?

Engagement -Does the film spark emotions among the audience?
-Does the film initiate thoughts and ideas among the viewers?

Technical Quality Cinematography
-Was the mobile phone fully utilized in making the film?
-Is the camera maximized to improve the story?
-Is the lighting used to enhance the different scenes in the film?
Editing
-Are transitions smooth and not distracting?
-Are all credits easy to read?
-Is the subtitle synchronized with the scene and the dialogue?
-Does the editing supplement the flow of the story and complement the pace of the film?

G. Miscellaneous

-The participation in the contest is entirely voluntarily.
-The selection and number of judges shall be NMS-Cares, Inc. sole discretion. The decision of NMS-Cares, Inc. and the judges shall be final and binding.
-Furnishing any false information or concealment of any material facts in the application form will result in immediate disqualification.
-NMS-Cares, Inc. reserves the right to withdraw or alter the terms of the film fest. All changes shall be posted on the website and social media. It is the responsibility of the participant to keep themselves informed to any changes.
-NMS-Cares, Inc. assumes no responsibility for any errors, omissions, interruption, deletion, defect, delay in operation or jumbled, scrambled transmission, communications line failure, theft, destruction, or unauthorised access to the microsite, website of the Film Contest or NMS-Cares, Inc. or program or programming error or failure, or failure to capture any entry information. NMS-Cares, Inc. and its sponsors shall not be responsible for injury or damage caused to the Participant or any other person, relating to or resulting from participation in the Contest, or from downloading materials or accessing the website or microsite of NMS-Cares, Inc. or Film Festival. NMS-Cares, Inc. is not responsible for any problems with or technical malfunction of any telephone or internet network or lines, computer online systems, servers or providers, computer equipment, software, failure of any email entry to be received on account of technical problems or traffic congestion on the internet or at any website, human errors of any ind, or any combination thereof.
-The Participant understands and accepts the following Terms and Conditions:
-The Participant represents and warrants that s/he is not under any contract with any person, firm, corporation or authority that would prevent her/his participation in the contest and displays of the film or any other matter connected therewith and agrees to indemnify NMS-Cares, Inc. against any claim that may be brought against it in this regard or any loss that may be caused due to it.
-The Participant understands and accepts that she or he shall not copy or use the ideas of a third party or another Participant at any stage in the contest. The Participant accepts that she or he has not infringed upon and shall not infringe upon the copyright or other intellectual property rights of any other person by creating and submitting the film. The Participant ensures and acknowledges that the Participant is the author of, or the owner or the licensee of the copyright of the story, write-up, script, depiction, music, graphics, photographs, images, screenplay, sound recording, lyrics, background scores, dialogues, titles, subtitles, and other literary, dramatic, musical or artistic works used while creating and developing the short film, and that it has not been copied in any manner from any source whatsoever and has full right to provide the short film during the Mobile Film Contest, participate in the contest receive award and permit NMS-Cares, Inc. to upload, exhibit, display the film, and conduct voting as stated in the Terms and Conditions.
-The Participant shall not have any claim against NMS-Cares, Inc. or its sponsors in the case of cancellation or postponement of the contest.
-By participating in the contest, the Participants agree to release, discharge, hold harmless and indemnify NMS-Cares, Inc. and its Sponsors, partners, affiliates, subsidiaries, advertising agencies, agents and their employees, officers, directors, and representatives from any claims, losses, liabilities, costs, debts, expenses (including but not limited to attorney's fees) and damages arising our of their (1) participation in the Contest or any Contest-related activities; (2) use of and access to the websites for the Contest; (3) any violation of any third party right including without limitation any copyright, property or privacy right; (4) the acceptance and use, misuse, or possession of any award awarded hereunder (5) breach of representations, or of any of these Terms and Conditions. This indemnification obligation will survive these Terms and Conditions and the Participants' participation in the Contest.
-The Participant acknowledges that in any case any of the terms of these Terms and Conditions is deemed invalid or unenforceable or prohibited by applicable law, such portion shall be considered divisible and shall not be considered part of the consideration, and the remainder of these Terms and Conditions shall be valid and binding and of like effects as though such provision was not included herein.
-The Participant agrees and undertakes not to engage in any press, publicity or other discussion with any other third party in connection with their entry forms or their participation in the Contest or any other aspect of the Contest before, during, or after the Contest, without obtaining prior written approval of NMS-Cares, Inc..
-The title "NMS-Cares Mobile Film Contest" is a trademark and property of and belonging to NMS-Cares, Inc. No Participant or winner shall acquire any right to retain the title or use the title to create promotional or publicity materials such as photographs, flyers or create any website or microsite with trademarks, images, logos, content or videos or any publicity material in any endeavours, public or private, without the prior or written permission of NMS-Cares, Inc.
-NMS-Cares, Inc. reserves the right to disqualify any entry on any of the following grounds:
-The film submitted contain obscene, defamatory, libellous-, abusive, harassing, tortuous, intimidating, vulgar, pornographic, profane, threatening, invasive private or publicity rights or otherwise objectionable, or unlawful subject matter or which constitute or encourage a criminal offence, violate the rights of any party or otherwise give rise to liability or violates any law, in its absolute discretion
-Providing any false information or concealment of any material facts and/or information in the registration from will result in immediate disqualification of the entrant from the contest.
-NMS-Cares reserves the right in its absolute discretion to disqualify any entrant at any stage if there is any reasonable ground to believe that the participant has breached any of the Terms and Conditions, any applicable law, or has infringed the intellectual property rights of any other person. Every participant acknowledges and agrees that any failure to comply with the Terms and Conditions could lead to NMS-Cares disqualifying the participants, without NMS-Cares giving any reason for such disqualification or granting any opportunity for challenge.
-The Terms and Conditions, any dispute or claim arising out of or in connection with them or their subject matter including the Contest, existence, negotiation, validity, termination or enforceability shall be governed by and construed in accordance with applicable laws of the Philippines.
-The courts of the Philippines shall have exclusive jurisdiction in relation to any and all dispute or claim arising out of or in connection with the Terms and Conditions.
